Court, Judge and County: This appeal is taken from a Decision and Order
dated June 6, 2006 of the Hon. Thomas J. McNamara, Acting Supreme Court Judge,
Albany County, in the above entitled case, RJI No. 01-05-081545 and Index No.
1711-05.
Nature and Object of Action or Proceeding: The underlying action seeks a
judgement declaring the State’s system of funding education for Appellant Small
City School Districts and for similar school districts to be in violation of
Article XI, section 1, of the NYS Constitution, by its failure to provide the
financial resources necessary for a sound basic education. It seeks a judgement
enjoining the defendants to create and maintain a system of funding sufficient
to provide an opportunity to students in such districts to receive a sound basic
education.
Appellate Issues: This appeal seeks a reversal of the Decision and Order
granting the State’s Motion to Dismiss the Amended Complaint. The decision found
that the Amended Complaint did not state a cause of action by virtue of its
failure to assert district wide educational deficits for each of the eighteen
Appellants’ Districts. It found that the Amended Complaint did not state a cause
of action under State Finance Law section 123-b. It found that Appellant
Association did not have capacity to sue. We believe that the decision and order
are based upon a misreading of the Amended Complaint and a misapplication of
relevant case law, and we are seeking its reversal and a reinstatement of the
Amended Complaint.
Other Related Matters: There is a related case pending before Judge
McNamara, Utica City School District v. State of New York, et al.. This
case is venued in Albany County. Utica CSD is a small city school district and
it is seeking relief similar to that requested in the instant case.
