DEBT CEILING
BILL ON AGENDA

S.6929/A.10559 (Volker/Canestrari) was on the Senate Local Governments Committee agenda for May 3rd. It was unanimously approved and reported to the Senate floor. This bill was drafted by the Association in 2002. It would permit the deduction of building aid from the computation of debt under the debt ceiling. A constitutional issue has been raised about the bill: can a statute interpret the definition of debt when the small city school debt ceiling is defined in Article VIII of the State Constitution. We are working on that issue with the Majority Leader's Counsel and with private bond counsel from NYC. If the answer is negative, we may have to approach the problem differently and will keep working on this important issue.

 

 

COUNTDOWN TO THE CONFERENCE

May 21 & 22, 2006

 

The Association has been working to put on its 20th annual conference later this month at the Gideon Putnam Hotel in Saratoga. The theme is “Interest Based Bargaining”. Registration is strong this year among the members and guests from NEA/NY and NYSCOSS will attend as well.

Thank you to everyone who has fielded calls, emails and faxes from our office. We appreciate your support of the Association and look forward to seeing you in Saratoga.

CFE UPDATE

Glens Falls CSD

Thomas McGowan, Superintendent of Glens Falls CSD, attended the latest informational meeting regarding the CFE case at NYSSBA Headquarters in Latham and provided this meeting summary.

There were approximately 25-30 people, representing various organizations that have been involved in the CFE lawsuit, in attendance.

Mike Rebell gave an overview of the most recent decision and outlined CFE’s request that the courts do an expedited hearing on the appeal.  The meeting focused on gathering input from the various groups about the next step and how to focus on specific issues.

Overall, there are four (4) areas that are specifically targeted for talking points:

1.        School Finance:

            Accountability
            State Aid Reform

2.         Strategy development – if a decision on the appeal is made in a timely fashion

3.         November ’06 elections – assisting groups working specifically with candidates for election.

4.         Communication (between and among groups)

            There was also discussion about the following: What is the message we want out and how do we get the message out?

How to marry 2 basic issues:

New York City’s issue of adequate resources to provide a sound basic education; and how to deal with the rest of New York State and the property tax issue versus adequate education funding resources.

The Association will continue to work collaboratively with CFE and other organizations to effectuate state-wide school finance reform.

 

 

Legal Corner

The Court of Appeals held, in Madison-Oneida Bd. Of Co-op. Educational Services v. Mills, that the abolition of teaching assistant positions is subject to the same statutory seniority provisions as apply to teaching positions.  The Court reached its conclusion by ruling that the use of “teacher” in Section 3013(2) of the Education Law encompasses teaching assistants.  Although the Court cited the Board of Education’s own policy on tenure as support for adherence to seniority principles, it also opined that the decision was mandated by the need for consistency in the interpretation of those statutes which impose requirements on the hiring and firing of teaching staff.
