SMALL CITY SCHOOL
DISTRICT LITIGATION UPDATE |
Two additional small city school
districts, Poughkeepsie and Middletown, have joined the Association’s
education finance litigation to bring the total to 18 named plaintiff
districts and 11 supporting small city school districts. Our goal of
receiving support from 35 of the 57 small city districts has nearly been
achieved. The 18 plaintiff districts serve over 106,000 students
collectively or 40% of the 260,000 children attending small city
schools. These districts are, therefore, a broad and representative
group of plaintiffs which can effectively assert the issues faced by
small city districts.
The Association is currently working
to meet its November 10th deadline for a response to the
Attorney General’s motion to dismiss. The AG then has until December 9th
to serve his reply. After that, all papers will be delivered to judge’s
chambers on January 2nd (motion return date). As reported in
the last newsletter, the assigned Judge, the Hon. Joseph Cannizzaro,
passed away after a long struggle with cancer. His replacement will be
elected in the upcoming November elections and it is most likely that
the case will be reassigned to this new judge at that time. Typically a
judge will take one to two months after the return date for a decision,
but there is no time limit imposed on the judge.
The Association’s response will be
made in two ways: one, the response will argue that the AG’s claims that
i. the Association and named plaintiff school board members lack
capacity to sue and standing to sue, and ii. the complaint fails to
assert the specific educational failures needed to support a cause of
action, are without merit. Two, the response will argue that the AG’s
motion is moot in as much as the Association will have filed an amended
complaint addressing the claims raised in the AG’s motion. Amendments to
the complaint will include addition of the Governor and the Commissioner
of Taxation and Finance as defendants. This amendment will allow the
plaintiff Board of Education members to maintain the suit as citizen-tax
payers under section 123 of the State Finance Law. Amendments will also
include the addition of parents as plaintiffs and the addition of
specifics regarding educational shortcomings as shown by the Chapter 655
Report profiles and the Association’s Litigation Survey.
While we believe our position
regarding the AG’s motion is strong, we do believe that in the
likelihood we are successful, the AG will nevertheless attempt to appeal
any decision to the Court of Appeals, both as a delaying tactic and as a
means of seeking a narrowing language of the 2003 CFE decision. |

MEET IN
ALBANY |
The SCSD Executive Committee met on
October 3rd in Albany. In attendance were, Joan Purtell,
President (Binghamton BOE), Norma Barton, Secretary (Canandaigua BOE),
Thomas McGowan, Immediate Past President (Glens Falls Supt.) and Raymond
Fashano, via teleconference, Executive Vice President (Jamestown Supt.).
Discussed were the Association’s finances both general and for the
ongoing litigation, legislative and litigation priorities for the
upcoming year, and the Association’s events such as the November 15th
seminar detailed below, the upcoming meeting with Commissioner Mills on
November 28th and the annual conference scheduled this year for May. .
Legislative, litigation and regulatory priorities for 2006 will be
discussed at greater length at the Board of Directors meeting scheduled
for November 28th, prior to the meeting with the
Commissioner.
The Committee concluded that
enthusiasm for both the Association’s activities and for the Education
Finance Litigation is high, as evidenced by the strong financial support
provided by member districts. It was also concluded that the Board of
Directors and the membership should be encouraged to take a more ‘hands
on’ approach to its lobbying efforts in the coming year. To begin with,
meetings with the Governor’s office and the Division of Budget will be
scheduled for the Board immediately after the meeting with the
Commissioner on November 28th. More information will be
announced regarding future scheduled meetings with the Legislature and
key staff.

REGENT BOTTAR TO SPEAK AT
ASSOCIATION BREAKFAST

Regent Anthony Bottar has agreed to
speak to our members during the annual Association breakfast this year.
The breakfast is being held during the NYSSBA conference at the Hyatt
Regency in Rochester on Friday, October 28th at the Clarion
Riverview Ballroom beginning at 7:30am. Below is a brief biography of
Regent Bottar. We look forward to hearing from him.
Anthony S. Bottar,
Onondaga, was elected to a five-year term as the Regent for the Fifth
Judicial District. His term began April 1, 1996 and expires on March 31,
2001.
His professional
experience includes positions teaching social studies in Rochester,
1972-1973; Assistant Corporation Counsel, City of Syracuse Department of
Law, Office of the Corporation Counsel, 1978-1982; Associate Counsel in
the firm of Birnbaum, Manaker & Aquilio, Syracuse, 1982-1983; and
Partner in the firm of Cherundolo, Bottar and McGowan, P.C., Syracuse,
1983 to now.
Regent Bottar has
been involved intensively with education organizations in the community.
His involvement includes positions as Trustee of the North Syracuse
Central School District Board of Education from 1988 to 1996, and as
President of the Board of Education from 1989 to 1996; and as member of
the Board of Directors of the Onondaga-Madison School Boards Association
from 1994 to now. |
