LEGISLATIVE UPDATE

The NYS Legislature adjourned last month with promises to return in August to finish important business including reform of the Rockefeller drug laws and increase of the state minimum wage. However, as weeks slipped by, it became obvious that there was little incentive to either House or to the Governor to reach agreement on these and many other issues… at least not until the September 10th Democratic primary gives the Democratic party nomination for Governor to either Comptroller Carl McCall or Andrew Cuomo. Even then, there might be no need from a political standpoint to return to Albany before the November elections.

 

Despite this apparent standoff between the major political parties and the failure to complete the work of the 2002 legislative session, small city school districts can take some comfort that progress has been made in several key areas of concern. In connection with the approval of the State Budget for 2002-03 the more than $7 million in Executive Budget cuts to Hurd Aid were restored. Hurd Aid represents about 6% in total aid to small city school districts and the $7 million is nearly 9% of the total aid increase this year to our districts. This success may provide a foundation on which the Association can build to obtain amendments to the Hurd Aid formula to permit some growth in that aid category.

 

In addition, the State Budget provided for inclusion in Special Services Aid for the five small city districts which are not members of a BOCES and which have not received any aid for their occupational education programs. This was an issue which had been a long-standing inequity for the districts involved, Albany, Troy, Amsterdam, Newburgh and Lackawanna. Special Services Aid will now annually bring a total of nearly $6 million in additional aid to these districts. Our congratulations go out to them and to the Superintendents and board members who worked so long and hard to make this happen.

 

Another State Budget development of note involved the reversal of the recent trend which has seen small city districts receive smaller increases in state education aid than the average district. Total aid for small city districts (excluding building aid, rescue and Hurd) increased from 2001-02 to 2002-03 by 6.85% compared to the state average of 4.96%.  This represents a major success for the Association, which has lobbied vigorously for greater equity in aid distribution. However, we are aware that a number of small city districts may not have benefited this year to the same extent as others. We are continuing to look at those situations to insure that the Association’s position on state education aid reflects as broad a range of concerns and issues as possible. Our efforts on the debt ceiling issue, which is affecting a growing number of our districts, likewise met with success. A bill which would authorize a referendum on the repeal of the state constitutional ceiling on debt for small city districts was approved by both Houses. The bill must be passed again next year in order for the referendum to be voted on in November of 2003. Prospects for Legislative approval in 2003 of this legislation are good. This bill would enable a number of districts to go forward with major construction and renovation projects which already are on the drawing boards and which are sorely needed. Left hanging, however, was a bill, which would have allowed small city districts to deduct building aid from the computation of the debt ceiling. This bill was poised for approval and if the Houses return to Albany this year may yet be passed.

 

One major priority of the Association on which little progress has been made is Charter School funding. The Association’s position on Charter Schools is to oppose the current funding scheme, not Charter Schools themselves. The timing for an initiative on this issue has not been good in the past few years. However, this continues to be a major concern of many small city districts and should be an issue the Association gives a high priority.

 

The June 25th decision of the Appellate Division (1st Dept.) in CFE v. NYS reversing the trial court decision was a great setback to those working for greater equity in school funding. The Appellate Division, in effect, has held that the State Constitution only requires that an education at the eighth grade level in reading and the sixth grade level in arithmetic be provided. (We imagine that the Court of Appeals is very uncomfortable at the thought of having to confirm that finding and declare to the entire state and nation that the Appellate Division’s decision represents the definitive word on the Empire State’s education policy.) CFE, which says this is only a “bump in the road” on the way to the Court of Appeals, has filed its appeal and expects an argument before the Court in January 2003. The Association filed an Amicus Curiae, friend of the court, brief with the Appellate Division, and we were gratified to read that the dissenting opinion reflected some of the arguments made by the Association. The Association will be filing an Amicus brief with the Court of Appeals as well.

 

  In anticipation of the CFE decision, the Midstate Consortium developed a proposal for state aid formula reform. Under the proposal many small city districts would receive significant increases in aid. However, the average small city district would receive much less than the state average, 22% for small city districts and 25% for the state average.  The new formula appears to fall short, by a large margin, of improving equity.  The Association board will be reviewing the Midstate proposal and reporting to the membership on its recommendations later this Fall.

 

 The Association also followed many other legislative issues this year and a brief summary of the more important of these is included below. The Governor’s office has contacted the Association on a number of pieces of legislation, including a bill to increase retained surplus and a bill to increase bus driver training for children with special needs. We have provided our positions on these to the Governor’s counsel, James McGuire, after canvassing the board and the appropriate Association committees. Our thanks go out to everyone who participated in that process.

 

 

SUMMER CONFERENCE IN ITHACA

The annual conference was held in Ithaca this year on August 18 and 19. The conference theme was character education and speakers included Dr. Robert Brooks, a renowned expert in the field who talked about “school climate” and “student and teacher motivation.” Also speaking to the theme were Steve Uebbing, Superintendent from Canandaigua CSD, Mark Ward, Superintendent from Salamanca CSD and Richard Parisi, Principal from the Liverpool schools. Many inspiring examples of success with character education programs were shared and the presentations were uniformly excellent and well appreciated. The new Regents Chancellor Regent Robert Bennett was the Monday breakfast guest speaker and NYSCOSS Deputy Executive Director Tom Rogers spoke at lunch. Summaries of these presentations will appear in the September newsletter. The Association’s thanks must go out to the Program Committee, to Co-Chairs Judith Pastel and Dr. Richard Jorgensen, and to committee members Dr. Ronald Friedman, Michael Egan and Dr. John Lutz. The enthusiastic response from attendees at the conference was the direct result of the careful and thoughtful planning of the conference by the committee.
